The TCPA also prohibits junk faxes. The statute acknowledges that intrusive and abusive telemarketers increase consumer costs, are harassing, and invade privacy. Thus, the TCPA entitles people who experience these prohibited marketing tactics to recover statutory penalties for each violation.

In addition to prohibitions on junk faxes and do-not-call violations, the TCPA expressly prohibits automated, artificial, or prerecorded calls or text messages “to any telephone number assigned to a paging service, cellular telephone service, specialized mobile radio service, or other common carrier service, or any service for which the called party is charged.” 47 U.S.C. 227(b)(1)(A)(iii). You may be entitled to act as a class representative and recover damages if you have received an advertisement on your cell phone, spam text message, or a junk fax.
